1. Agreement to Terms

By accessing or using the Scan. Check. Protect. platform ("SCP," "the Platform"), you ("User," "you") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms in their entirety, you must not use the Platform.

These Terms constitute a legally binding agreement between you and True the Vote, Inc.,3120 Southwest Fwy, Ste 101, Houston, TX 77098, a Texas nonprofit corporation ("True the Vote," "we," "us," "our"), which owns and operates SCP.


2. Eligibility

You must be at least 18 years of age to use this Platform. By using SCP, you represent and warrant that you are 18 or older and have the legal capacity to enter into this agreement. SCP is available only to persons located within the United States.


3. Description of the Platform

Scan. Check. Protect. is a civic engagement platform that enables U.S. citizens to:

  • Check their voter registration status or that of a family member by submitting identifying information to the relevant state voter registration authority;

  • Report potential inaccuracies in voter registration records, voting histories, or roll maintenance;

  • Generate demand letters citing applicable federal law, including the National Voter Registration Act of 1993 ("NVRA"), 52 U.S.C. § 20507, for submission to county clerks, state election boards, and federal officials;

  • View aggregated, estimated voter roll data on a national intelligence map.

SCP is an investigative and civic documentation platform. It is not a government service, is not affiliated with any election authority, and cannot change, correct, or remove any voter registration record. Results, reports, and demand letters produced by SCP do not guarantee any official action by any government body.


4. How Registration Checks Work — Important Notice Regarding Your Information

When you submit a voter registration check through SCP, the Platform operates as follows:

Information retained by True the Vote: True the Vote retains only your basic contact information — specifically your name, email address, and phone number — for the purposes of case management and follow-up communication.

Information transmitted to the state: Any additional personally identifying information you provide to facilitate a voter record lookup — including but not limited to your driver's license number, the last four digits of your Social Security Number, tribal identification number, or other state-required identity verification credentials — is transmitted directly to the voter registration authority of the state from which your voter record is being requested. This information is not retained in True the Vote's systems beyond what is necessary to facilitate that transmission.

By submitting a registration check, you expressly authorize True the Vote to transmit your identifying information to the applicable state voter registration authority on your behalf for the purpose of retrieving your voter registration record.

You should review the privacy practices of your state's election authority, as that entity's policies — not this Privacy Policy — govern how they handle the information transmitted to them.


5. Permitted Use

You agree to use the Platform only for lawful, civic purposes. You agree to:

  • Provide accurate and truthful information in all submissions;

  • Use the registration check feature only for your own record or that of a family member, household member, or individual for whom you have a legitimate civic interest;

  • Not submit information you know to be false, misleading, or fabricated;

  • Not use the Platform to harass, intimidate, or harm any individual;

  • Not use the Platform for commercial solicitation, data harvesting, or any purpose unrelated to voter integrity;

  • Not attempt to circumvent, disable, or interfere with the Platform's security or infrastructure;

  • Not use automated scripts, bots, or scrapers to access or interact with the Platform;

  • Not collect, retain, use, disclose, or solicit information about other SCP users, or any information obtained through the Platform, for any purpose outside of your own civic voter registration inquiry. This prohibition applies regardless of how such information was obtained and expressly includes, without limitation: 

    • Media publications, journalism, or press releases; Social media posts, stories, or broadcast content of any kind;

    • Political campaigns, political action committees, or partisan advocacy;

    • Opposition research or competitive intelligence;

    • Commercial solicitation or advertising;

    • Fundraising appeals of any kind;

    • Harassment, intimidation, stalking, or doxxing of any individual;

    • Compiling, aggregating, or cross-referencing information about other users obtained through the Platform with data from any external source; or

    • Any other purpose not directly and exclusively related to your own civic voter integrity inquiry through the Platform.

True the Vote takes the privacy of our team and SCP users very seriously. Violation of this provision may result in immediate and permanent termination of your access to the Platform without notice, and may be reported to appropriate law enforcement or government authorities where applicable. True the Vote reserves the right to take legal action against any individual or entity who violates these terms and conditions.


6. Nature of Reports and Legal Filings

SCP may provide instructions or sources on how to file a report and with which entities. By filing a report, complaint, or pro se lawsuit, you agree that:

  • These reports are for informational and civic purposes only and do not constitute legal advice;

  • True the Vote and SCP are not law firms and do not represent you in any legal capacity;

  • No attorney-client relationship is formed between you and True the Vote at any time;

  • Submission of a demand letter does not guarantee any response, investigation, or corrective action by any election authority;

  • You are solely responsible for reviewing any document before transmitting it to a government official;

  • You are not providing false information;

  • You are submitting a report, complaint, or pro se letter at your own expense and free will;

  • If you intend to pursue legal remedies under 52 U.S.C. § 20510, you are strongly encouraged to consult a licensed attorney.


7. Accuracy of Information; No Guarantee of Results

The Platform uses publicly available voter roll data and estimated figures for display purposes. All data on the Intelligence Map is provided for informational purposes only and represents estimates, not confirmed findings.True the Vote makes no warranty as to:

  • The completeness, accuracy, or currency of any voter roll data displayed;

  • Whether any registration record is actually valid or invalid;

  • Whether any government body will act on a report or demand letter;

  • The outcome of any administrative or legal proceeding.


8. Donations

SCP does not charge users for any feature of the Platform. The Platform may offer users the opportunity to make a voluntary donation to True the Vote, Inc. to support its civic advocacy mission. Donations are:

  • Entirely voluntary and not required to access any feature of the Platform;

  • Made directly to True the Vote, Inc., a [501(c)(3) organization;

  • Subject to True the Vote's separate donation terms and applicable IRS regulations.

True the Vote is a nonpartisan organization recognized under section 501(c)(3) of the Internal Revenue Code, Federal Tax ID #27-2860095. Contributions or gifts to True the Vote are tax-deductible as charitable contributions for federal income tax purposes to the extent permitted by law. Donations are non-refundable. Donors do not receive any goods or services in exchange for any part of their contributions.


9. No Government Affiliation

SCP is a private civic platform operated by True the Vote, Inc. It is not affiliated with, endorsed by, or operated on behalf of the U.S. federal government, any state government, any election authority, or any political party. True the Vote has no authority over voter registration records and cannot compel any government action.


10. Intellectual Property

All content, design, software, and data compilations on the Platform are the property of True the Vote, Inc. or its licensors. You may not reproduce, redistribute, modify, or create derivative works from any Platform content without the express written consent of True the Vote.


11. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, TRUE THE VOTE DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DATA DISPLAYED IS ACCURATE OR COMPLETE.


12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRUE THE VOTE, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE PLATFORM, INCLUDING RELIANCE ON ANY DATA, DEMAND LETTER, OR REPORT GENERATED THROUGH THE PLATFORM, OR ANY GOVERNMENT ACTION OR INACTION IN RESPONSE TO A FILING.

TRUE THE VOTE'S TOTAL LIABILITY TO YOU SHALL NOT EXCEED [$100, OR THE MINIMUM AMOUNT REQUIRED BY APPLICABLE LAW].


13. Indemnification

You agree to indemnify, defend, and hold harmless True the Vote, Inc. and its officers, directors, employees, volunteers, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of:

  • Your use of the Platform;

  • Your violation of these Terms;

  • Your submission of false, inaccurate, or misleading information;

  • Any filing you make with a government body based on Platform-generated materials.


14. Modifications to Terms

True the Vote reserves the right to modify these Terms at any time. Changes will be posted to this page with an updated effective date. Continued use of the Platform after any modification constitutes acceptance of the revised Terms.


15. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Houston, Texas, and you consent to the personal jurisdiction of such courts.


16. Severability

If any provision of these Terms is found to be unenforceable, it shall be modified to the minimum extent necessary to make it enforceable. The remaining provisions shall continue in full force.
